Liability Waiver

Take a minute to read through and sign our liability waiver. By agreeing to an appointment with CO:SIGN.LAB.LLC (CO:SIGN.LAB合同会社) hereafter be known as CO:SIGN, you are voluntarily agreeing to our liability waiver.

Inherent Risks

Automobile/Vehicular Collisions

As the activity includes travelling to a location(s) chosen by you, the path may include but is not limited to trains, cars, and/or bicycles. The risk inherent to those travels would naturally include the possibility of collisions, whether by any of the above or by other means. You agree to release us from any responsibility regarding such situations, as well as release us from any medical and financial claims.

Air-/Food-/Vector-borne Illnesses

Since the activities travel through the city, passing by its many inhabitants, whether they are involved with CO:SIGN or not, and since the activities may include eating at restaurants, dinery, etc., or getting a take-out, bento, etc., there are a natural risks obtaining of air- or food-borne illnesses as well as vector-borne illnesses (from insects such as mosquitos and ticks). 

Misunderstandings

As the host is in the middle of studying your language (and/or vice-versa), there naturally exists the possibility of misunderstanding borne of miscommunication, cultural difference, and/or mistranslation, you agree to take all responsibility to make clear to your host where exactly you want to go and what exactly you want to do, and to ensure that your host understood you. As such, you agree to release us from any and all responsibility if such communication/cultural disconnect occurs.

Assumption and Acknowledgement of All Risks

I and/or my child are freely volunteering to participate in the activities offered by CO:SIGN and I understand that there could be dangers and cautions involved in the activities I or my child will be participating in, including, but not limited to: dangers associated with travel, sharp objects, exposure to illness, etc. I understand that I am entirely responsible for deciding whether I and/or my child participates in any activities with CO:SIGN, and for deciding what activities in which I/we can safely participate and that we can voluntarily end the trip at any time for any reason.

Release Clause

You agree, on your own behalf and on the behalf of all listed minors, if any, to expressly waive any and all claims, suits, or demands for personal injury, property damage, or other loss against CO:SIGN, including but not limited to any and all negligence, negligent supervision, and/or negligent instruction, or the activities of others. You also agree, knowingly, voluntarily, and freely accept and assume any and all risks, both known and unknown, of injuries or damage or other loss that may be suffered while on the trip, however caused. 

Amicable Resolution

If any matter not specified in this waiver or any doubts arise regarding the interpretation of this waiver, CO:SIGN and you shall negotiate in good faith and seek to reach an amicable resolution.

Indemnification

You agree to indemnify, defend, and hold harmless CO:SIGN from and against any and all liability, costs, property loss, medical bills, loss of income, expenses, attorney’s fees, liens, subrogation rights, and all other damages of any kind or nature whatsoever, and from any suits, claims, or demands, including legal fees and expenses whether or not in litigation, arising out of or related to your participation in the activities.

Governing Law

In the event I file a lawsuit against CO:SIGN, I voluntarily agree to litigate only in a court in the Osaka prefecture. I further agree that the substantive law of Osaka shall apply in that action without regard to the conflict of law rules of that prefecture.
